Welcome to the Fairfax Heritage X Condominium Unit Owners Association aka Talltree South Condominium Unit Owners Association (the “Association”) website, also known as “www.talltreesouth.com” or the “Site.” The primary goal of the Site is to provide a safe, decent, fair, and effective platform for intra-condominium communication and electronic interaction. 

We welcome people from our condominium association who wish to share information, experiences and opinions.  The term “Neighbors” refers to residents or owners of condominium unit within the Fairfax Heritage X Condominium aka Talltree South Condominium governed by the Association who have registered as users of this Site. In the spirit of kindness, tolerance, and good manners, all Neighbors shall abide by the following code of conduct, and comply with the terms and conditions set forth herein (“Terms of Use Policy”).

Good Neighbor Conduct

We welcome people of all ages, races, religions, genders, national origins, sexual orientations and points of view. We do not tolerate expressions of bigotry, hatred, harassment or abuse, nor will we tolerate threats of harm to anyone. Because we encourage discussion and the exchange of ideas, we do not allow defamatory, abusive, tasteless or indecorous content or statements. For the same reason, we do not allow sexually explicit material on the Site, nor links to such material. Notwithstanding the foregoing, it is expressly agreed, by participation in the Site that the Association is not responsible for any content posted by Neighbors, and Neighbors are solely and individually responsible for the quality and accuracy of any content they may post on the Site.

Ownership of Copyright and Intellectual Property

All materials found in the pages of this website are protected under the copyright laws of United States and of other countries. Certain names, words, titles, phrases, logos, icons, graphics or designs in the pages of this website may constitute trade names, trademarks or service marks of the Association, or the use of which may have been licensed to them.  The display of trademarks, trade names or service marks on pages at this Site does not imply that a license of any kind has been granted to anyone else.  Any unauthorized downloading, retransmission, republication or other copying or modification of material posted on this website, including trademarks, trade names, and service marks, may violate federal, provincial, common or civil law trademark law and copyright law, and result in legal action.

Materials, Documents and Information Contained on the Site

Materials, documents and information (e.g. Association Documents) contained in this Site are for informational purposes only. The Association, its directors, officers, members and agents make no representations about the suitability of the information contained in the documents and related graphics published on this Site for any purpose.

The materials, documents and information contained on this Site are believed to be accurate and complete at the time of posting.  Although the Association attempts to ensure that all information, documents and materials remain current and accurate, the Association does not warrant their accuracy, completeness and currency at all times. In addition, the Association does not warrant the accuracy, adequacy, completeness, or software algorithms and expressly disclaims liability for error or omission in any software algorithms.

The information, documents, materials and software algorithms contained on this Site or which may be downloaded from this Site, including text, graphics and hyperlinks, are provided “as is” and “as available.”  The Association does not warrant, guarantee or otherwise endorse any particular product, vendor or service that may be advertised on the Site. The Association is not responsible for the contents of any advertisement, or for the goods and services of our advertisers. In no event shall the Association be liable for any direct, special, indirect or consequential damages or any damages whatsoever arising out of or in any way connected with the use or performance of the Site.

No Illegal Activities

The Association does not allow any illegal activities. Specifically, all participants shall not use the Site to advocate illegal conduct or participate in illegal or fraudulent schemes. You can not use the Site to distribute unauthorized copies of copyrighted material, including photos, artwork, text, recordings, designs or computer programs. In addition, you may not post, or use, computer programs that contain destructive features, such as viruses, worms, Trojan horses, bots scripts and any other form of invasive software.

Communication Services

The Site may contain bulletin board services, chat areas, forums and/or other message or communication tools designed to enable Neighbors to communicate with the public at large or with a group (collectively, “Communication Services”).  Postings to and transmission between parties via the Communication Services are not reviewed prior to appearing on the Site. We reserve the right to remove messages that are flagged as inappropriate by any Neighbors that express concern through separate communication with our webmaster. We reserve the right to edit, move, or delete any postings on the Communication Services, and to immediately terminate or suspend access to the Site for conduct that interferes with other Neighbor’s enjoyment of the Site.

The Site may provide forums that cover a number of topics; however, the Site’s staff and neighborhood moderators do not offer professional advice of any kind, and are speaking from their own experience or opinion as is helpful for the facilitating of conversation. Such personnel claim no professional expertise or authority. We do our best to encourage comfort and discourage disruptive communication. We also discourage disruptive statements that incite others to violate our standards. We encourage your participation in upholding our standards. When in doubt about appropriate behavior here, remember that although the Site is a virtual community, the people here are real. So, just as when you join any gathering of people, we ask that you treat others with mutual respect and with care.

Solely as a courtesy to you, we may provide links to other websites at certain places on our Site; however, we do not endorse, approve, certify or control any of those websites.  Because we do not have any control over such websites, you acknowledge and agree that we are not responsible for the content of the websites or the availability, accuracy, completeness, efficacy, or timeliness of information contained on those websites. In addition, we are not and will not be responsible for webcasting or any other form of transmission received from any linked website. Use of those websites or any information obtained from those websites is voluntary, and reliance on it should only be undertaken after an independent review of its accuracy, completeness, efficacy and timeliness.

There may also be advertisements and classifieds for products and services contained on the Site.  These advertisers are not affiliated with the Association and the Association is not responsible for the contents of any advertisement, or for the goods and services of our advertisers. Users of this Site are encouraged to make their own evaluation of such goods and services.  The Association does not endorse or recommend any commercial products, processes, or services.  The Association is providing these links and advertisements to you only as a convenience, and the inclusion of any link or advertisement does not imply endorsement by the Association of the linked site or the advertiser.

Security

The exchange of information such as passwords or electronic mail, between the Site and Neighbors, may not be secure given the structure of the Internet. Consequently, although this Site may have standard security measures in place that are intended to protect against the loss of information that we collect, you should keep in mind that this Site is run on software, hardware and networks, any component of which may, from time to time, require maintenance or experience problems or breaches of security. At present, the login capability is only for members of the Board of Directors.  Should the Site allow Neighbors to log in, the Site encourages Neighbors to change their passwords frequently. Each Neighbor is responsible for protecting the privacy of his/her password. Postings and other communications with the Site are not private and may be published and edited at the discretion of the Site.

Agreement

Your use of the Site constitutes your unconditional agreement to all of the terms contained in this Terms of Use Policy.  If you do not agree to these terms and conditions, then do not use the Site, and do not register as a Site user.  If you know of any violation of this Terms of Use Policy, please contact the Community Manager at the e-mail address set forth below, with the subject "Terms of Use."  Notwithstanding anything to the contrary herein, the Association reserves the right, in its sole discretion, to terminate your access to the Site and any related services at any time, without notice.

The Association retains the right to update this Terms of Use Policy by posting a revised Terms of Use Policy on the Site, and such revisions will take effect upon posting.

    In Legal

    If payment is not received by the Managing Agent (Cardinal Management Group) within 45 days after the due date, legal action will be initiated.

    Your account will be sent to the law firm. Remaining installments of the annual assessment will be accelerated, and action to collect fees owed will be undertaken, which may include filing a lien or suit to collect all sums due to the Association, including delinquent assessments, late charges, administrative fees, costs, and reasonable attorney's fees. At this point, you will be dealing with the law firm rather than the Managing Agent. Please don't make us send you to legal!
